1. Who we are
These terms cover everything on hersky.info, operated by Jake Hersky in Ottawa, Ontario, Canada: the merch shop, DJ and entertainment bookings, and web design services. By using the site or buying from us, you agree to these terms.
2. Merch shop
Prices are shown in USD with a CAD currency toggle; the price at checkout is the price you pay. Taxes are extra where applicable — including 13% HST on orders shipped within Ontario. Discount codes are applied at checkout and can't be combined unless stated.
Every merch item is printed on demand by our fulfilment partner, Printful. Nothing is pre-made: your item is printed after you order it, which is why each piece is unique and why production takes a few extra days. Shipping is a flat $5.95 USD, free on orders over $75 USD. Delivery estimates are estimates, not guarantees.
3. DJ services
A 50% non-refundable deposit confirms your booking. The remaining balance is due as set out in your booking agreement — typically on or before the event date. If the balance isn't paid on time, we may cancel the booking and keep the deposit. Event details, set times, and production requirements are confirmed in writing before the event.
4. Web design services
Web design work is quoted per project and confirmed in a written agreement or proposal before work begins. A deposit is required to start; it becomes non-refundable once work has started. Timelines depend on receiving content and feedback from you on schedule.
5. Who can buy
You must be 18 or older to place an order or book services. By ordering, you confirm you meet this requirement.
6. Intellectual property
All HERSKY artwork, designs, logos, photos, videos, and site content are the property of Jake Hersky and protected by copyright. Buying a merch item gives you the physical product — not the rights to the artwork. Don't copy, reproduce, or resell our designs without written permission.
7. Acceptable use
Don't misuse the site: no scraping, no interfering with checkout, no fraudulent orders, and no uploading anything unlawful through our forms. We may refuse or cancel orders that look fraudulent.
8. Limitation of liability
To the maximum extent allowed by Ontario law, our total liability for any claim is limited to the amount you paid us for the product or service in question. We're not liable for indirect or consequential losses. Nothing here limits rights you have under the Ontario Consumer Protection Act that can't be waived.
9. Governing law
These terms are governed by the laws of Ontario and the federal laws of Canada. Any disputes will be handled in the courts of Ottawa, Ontario.
10. Changes
We may update these terms from time to time. The version on this page at the time of your order or booking is the one that applies to you.
